MAY 11,2013


'Forced to quit'-As said by the Times Now today morn, it was absolutely the word. The scams have now paved for a new twist and twirl with two ministers, both charged for two different stories Mr.Bansal,for a family corrupt case(as said and hope all got it)...and Mr.Aswani kumar,who is expected to preserve the law and order,being charged for 'vetting' CBI's affidavit in the Coalgate affair...

It was all drama yesterday...At the morn,when the Times Now started exhibiting the evidences one by one, to the time when both the ministers in the span of minutes arrived at 7 race course road in their official cars to put in their papers to the PM...

In ma point of view ,the eventful happenings this week clearly indicates that it does not depend on the party which rule, but exactly on the people in and around which brings in all these frauds.......

And finally the pak prisoner Sanaullah dies...and Pak has asked for an international enquiry on the same..the incident throwed him to hospital a day after the poor INDIAn prisoner Sarabjith Singh who was brutally attacked and killed in the Pak jail...

The Pak upcoming minister(as said by himself) in the coming elections Mr.Nawaz Sharif just had told yesterday that if he comes in to the power,he will stop all the cruelty against INDIA...And rightly,the incident which happened today clearly indicated that the relations between Pak and India will always remain a burning issue..

The times before 1947,when both were a single nation is being forgotten now...The British policy of 'Divide and Rule',which provoked Mr.Jinnah and his countrymen to fight for a separate muslim stonghold country has now seen its course...We can now only hope for a better situation...lets pray that the times before 1947 will be remembered at some juncture.....

And finally the karnataka polls are  out.....The reflections are quite clear about the reactions of people to what happened there about 6months ago..The uprising of a third union JDS(which had a stonghold once upon a time) and the single made party of Yedyurappa(who created the whole lot stress to the BJP govt through his scam),KJP which bagged some of BJP's seats ...and the congress can now smile....They can single handed ly rule one more south Indain state now...The story that happened in Himachal Pradesh is now repeating itself in Karnataka

The people have started reacting to reality...But it is still to happen at many places..The scam stories of Chidambharam,Reddy brothers,Raja....still many to be added to the list...Anyhw, BJP has lost one more state...The stronghold at karnataka is now a dream...The comeback of JDS and the victory of Congress...The election has brought the state to a new era..Lets hope for a better governance @ karnataka...

Union Public Service Commission [UPSC]


  • Central recruiting agency in INDIA
  • Articles 315 to 323 of Part XIV elaborates provision regarding composition,appointment and removal of members along with independence,powers and functions of UPSC.
COMPOSITION

  • Usually consists of 9-11 members including the Chairman and other members appointed by the President who determines the strength.
  • The Chairman and other officers holds the office for a term of 6 years or till they attain 65 years of age.
REMOVAL

  • The president can remove the members if he is adjudged an insolvent,if he is caught doing any other jobs outside his office or he is adjudged unfit to continue his term in the office.
FUNCTIONS

  • Conducts examinations for appointments to All India services,Central and Public services of centrally administered territories.

ELECTION COMMISSION


  • Article 324 provides power of super-intendence,direction and control to the Parliment,state legislatures,the office of president and vice president shall be vested in the election commission.
  • From 1950 to 15th October 1989,the election commission functioned as a single member body consisting of the Election commissioner alone.
  • On 16th October 1989,The President appointed 2 more election commissioners.Thereafter the commission worked as a multimember body of 3 election commissioners.
  • The 2 posts of election commissioners were abolished in January 1990 and was reconstituted in 1993.
  • The powers of the 3 commissioners are equivalent to the judge of supreme court.
  • They hold office for 6 years or until they attain the age of 65.
  • The powers of Election commission is divided in to ADMINISTRATIVE,ADVISORY and QUASI-JUDICIAL.
  • The functions performed by the Election commission are;

  • (a) Determine territorial area of constituencies based on Delimitation Commission Act of Parliment.
  • (b) Register all eligible voters.
  • (c) Notify dates and schedule of election.
  • (d) Allot election symbols to various parties.
  • (e) Settle the disputes
  • (f) Determine the code of conduct.
  • (g) Advice president relating disqualification of members.
  • (h) To cancel polls in events of violence.

  • The election commission is assisted by deputy commissioners 
  • At the state level,Election commission is assisted by Chief Electoral Officer appointed by the Chief Election commissioner in consulation with the state govt.
  • He appoints a returning officer for every constituency in the district and a presiding officer for every polling booth in the constituency

ADMINISTRATION OF SCHEDULED AND TRIBAL AREAS


  • Article 244 in the Part X of constitution describes the administration of 'Scheduled and Tribal areas'
  • The 5th schedule described the same except for the states of Assam,Meghalaya,Tripura and Mizoram.
  • The 6th schedule deals with administration of tribal areas of the above 4 states.
SCHEDULED AREAS

  • President has the power to declare and set the limits of an area as a scheduled area.
  • Although the executive powers of the state extends to the scheduled areas,the Governor is specially responsible for the administration of the areas.
  • A 'Tribes Advisory Council' is to be organised in each state with scheduled areas consisting of 20 members, three fourth of which are representatives of the scheduled tribes in the legislative assembly.
  • A governor can modify the laws for the scheduled areas after consulting with the Tribes advisory Council and getting an assent from the President.
  • A commission was appointed in 1960 headed by U N Dhebar and the 2nd commission was appointed in 2002 under Dilip Singh Bhuria.
ADMINISTRATION OF TRIBAL AREAS

  • The 6th schedule describes the special laws to be introduced to the aboringies of Assam,Meghalaya,Mizoram and Tripura
  • The tribal areas are configured as autonomous districts with each one having 30 members of which 4 are elected by the governor and the rest 26 by adult franchise.
  • The Governor can appoint any commission to examine and report any matter relating to autonomous districts or regions.

ADMINISTRATION OF UNION TERRITORIES


  • Union territories are under the direct control of the government
  • Articles 239 to 241 in Part VIII of constitution deals with Union territories.
  • Each Union territory is controlled by the President through an acting administrator appointed by him.
  • The acting administrator is designated as a Lieutenant Governor in case of Delhi,Puducherry and Andaman and Nicobar Islands 
  • He is designated as the Administrator in case of Chandigarh,Dadra and Nagar Haveli,Daman and Diu and Laskshadweep.
  • Union territory of Delhi and Puducherry is provided with a legislative assembly and a council of ministers headed by the C.M.
  • The strength of council of ministers is 10% of total strength of the assembly ie; 7.
  • The Bombay high court has jurisdiction over Dadra and Nagar Haveli & Daman and Diu.
  • Calcutta,Punjab,Haryana,Kerala and Madras High courts have jurisdiction over Andaman and Nicobar islands,Chandigarh,Lakshdweep and Puducherry
  • The 69th amendment of 1961 provides special status to Union territory of Delhi and registered it as a National capital territory.
